User Agreement (International version for app stores)

This version applies to users who access Speakylex via app stores (e.g. Google Play, App Store) or other distribution platforms in the European Union, European Economic Area, and other countries outside the CIS. For users in the CIS, the standard Terms of Use (RU/EN) may apply.

1. Acceptance of Terms
1.1. By using the Speakylex application, you agree to these Terms. If you do not accept them, delete the application immediately.
1.2. Before using the application, you must read these Terms and consent to the processing of your personal data as set out in our Privacy Policy (for app stores).

2. General Provisions
2.1. The application allows you to: learn languages via AI chat; use and create learning materials and phrase sets; practice with vocabulary/grammar tests and audio; study grammar; follow structured courses and track progress.
2.2. You agree to comply with this Agreement and not to use the Application in a way that infringes the rights of the Service provider or third parties or violates applicable law.
2.4. You may not: carry out unauthorized interference (e.g. DDoS, hacking); use bots, scripts or automated data collection without permission; resell or transfer account access for commercial purposes.

3. Age Restrictions
3.1. The Service is intended for users aged 16 or over (or the higher age required in your country for valid consent to data processing).
3.2. By registering, you confirm that you meet the minimum age requirement.
3.3. If we have reasonable grounds to believe you are below the minimum age, we may request verification (e.g. parent/guardian consent) or restrict the account; failure to provide it within 7 days may result in permanent blocking.

4. Social and Community Features
4.1. You may not: publish adult (18+) content; share contact details without consent; spread false information, spam or fraud; harass others; infringe copyright or trademarks or share others’ personal data without consent; distribute harmful unverified information; promote violence, hatred or discrimination.

5. Account Deletion and Suspension
5.0. You may request deletion of your account and personal data at any time by email to contact@speakylex.com with the subject "Account Deletion". After deletion, we process data as described in the Privacy Policy (retention and erasure).
5.1. We may suspend or delete accounts for material or repeated breach of these Terms, use of stolen payment means, or circumvention of payment systems.
5.2. You may appeal a suspension within 14 calendar days by sending a reasoned request to contact@speakylex.com. We will review it within 30 calendar days.

6. Intellectual Property
6.1. Lessons, algorithms and design are our property. You may not copy content for commercial use, decompile the application, or create derivative works (e.g. clones) for distribution or competition with Speakylex.
6.2. You keep ownership of content you create and grant Speakylex a perpetual, royalty-free license to use, reproduce, modify and display it within the Service.

7. Service Availability
7.1. We use reasonable efforts to keep the service available but do not guarantee uninterrupted access or specific speeds.

8. Artificial Intelligence
8.1. AI-generated content (translations, exercises, dialogues) is for learning only; it is not professional advice, may contain errors, and does not guarantee any result.
8.2. Use of AI features for purposes other than language learning within the Service (e.g. bulk generation, automated extraction) is prohibited and may lead to suspension.
8.3. AI coins (in-app virtual resource):
8.3.1. AI coins are virtual units of the Service. They may be provided under a subscription, promotions, or purchased as an add-on through app stores. AI coins are not money, cannot be withdrawn or exchanged for cash, and cannot be transferred to other users outside the Service;
8.3.2. AI coins are deducted when related AI services are successfully provided, including: chatting with the AI assistant; creating (unlocking) a practice lesson/assignment from a video; checking writing practice. The applicable cost is shown in the app before you confirm the action and may be changed by the Operator;
8.3.3. If the service is not provided (for example, lesson generation fails or a writing check fails), AI coins are not deducted or are restored to your balance as provided by the Service;
8.3.4. An already created (unlocked) assignment for the same video does not require payment again to create it; each successful writing check deducts AI coins separately;
8.3.5. Refunds of real-money payments for subscriptions or purchases are governed by the “Refunds” section and the rules of the relevant app store. AI coins spent after a successfully provided service are generally not restored, except where expressly required by these Terms, the store’s rules, or mandatory law.

8A. TikTok Creators (Google Play)
8A.1. Where available, you may sign in with TikTok (Login Kit), link a TikTok account, and (if you become a creator) use the Display API (including video.list) so selected public TikTok videos become discoverable in Speakylex for language learning. Speakylex synchronizes video metadata only and does not download, store, or re-host raw video files (e.g. MP4); playback uses TikTok’s official Embed iframe player / SDK.
8A.2. Creators must only submit educational language-learning content. We may refuse, hide or remove videos (including via automated filters and human moderation) and may ban creators who breach these Terms or TikTok’s terms.
8A.3. Learners may watch embeds free of charge. Creating (unlocking) a generated practice lesson/assignment from a video and checking writing practice may spend AI coins (see section 8.3); the cost is shown in the app. An already created assignment remains available in My Lessons even if the source video later becomes unavailable (e.g. TikTok access revoked).
8A.4. TikTok’s own Terms and Privacy Policy also apply to your use of TikTok. Speakylex is not affiliated with TikTok except as an independent app integrating TikTok Login/Display APIs.

9. Refunds
9.1. Refunds are governed by the rules of the store through which you made the purchase (e.g. Google Play, App Store). Eligibility, timing and procedures depend on that platform’s policy and, where applicable, EU or national consumer law.
9.2. If Speakylex later offers direct payment on its website, refund terms will be published there and will comply with applicable consumer law.

10. Subscription Cancellation
10.1. How to cancel and when access ends are determined by the rules of the store you used (e.g. Google Play, App Store). Please follow that platform’s cancellation process.

11. Changes to the Terms
11.1. We may change these Terms. We will notify you of material changes by email and/or in-app or web notice. The new version takes effect as stated in the notice. Continued use after that constitutes acceptance. If you disagree, you must stop using the Service and may delete your account.

12. Limitation of Liability
12.1. The Service is provided "as is". We are not liable for indirect, incidental or consequential damages or lost profits, to the extent permitted by applicable law.
12.2. Our total liability for any claim related to the Service is limited to the amount you paid for the Service in the 6 months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under your local law (e.g. EU consumer rights).

13. Applicable Law and Disputes
13.1. These Terms are governed by the laws of the country in which you reside or, where relevant, by the law of the European Union or the European Economic Area. If you are a consumer, you also benefit from mandatory consumer protection rules of your country.
13.2. You may use the European Commission’s online dispute resolution platform (ODR) if you are in the EU: https://ec.europa.eu/consumers/odr.
